Today, Ms.Tahata(lawyer of our law firm)came back to Japan , and the conference about Thailand , Asean was held in Japan University of Economics.
今日本企業が熱い視線を送るタイの実情がよく分かりました。
I understood of the actual stiation of the Thailand.
席が足らないほどの方がいらっしゃいました。
More than 70 people attended the conferense.
私も、中小企業のアセアン進出の御相談をお受けしているので、大変勉強になりました。
Now I am giving advice about how to make inroads into Asean markets with Mr.Hara,so I also learned a lot.
中国改正商標法と先駆け商標登録への対策というセミナーに参加しました。I attended the seminar “An Introduction on the Amendment to the P.R.C. Trademark Law and Countermeasures for Trademark Squatting ” .
新しい中国の改正法を学べ大変勉強になりました。I learned a lot.
日本の企業が気をつけるべき点を以下に記載しておきます。I introduce what Japanese company should pay attention !

★商標に関して日本の企業が気をつける点
・継続的なウォッチングを行う
・速やかに商標出願するー権利取得
・市場での侵害行為に注意すること
・侵害行為に対して速やかに措置を講じること
・侵害証拠を収集すること
・的確な戦略を立てること
★日本企業の証拠収集における対策
・先使用の時間、知名度を有した時間は係争商標の出願日より早くなければならない
・商標の使用、宣伝、知名度の状況を中国国内に限定されるのが原則。外国での知名度の証明材料は、中国にいる公衆に適切な方法を通して国外での知名度を知らしめていることを証明する必要がある。
・営業活動での商標使用について、使用に関する証拠は、商標標章、商標権帰属関係などの要素を含むことが重要
・証拠チェーンを有すること
・外国語の場合、中国語訳文の提供が必要、重要な国外証拠は、公証認証が必要。
講師の高革慧先生とは様々なお話をさせていただきました。外弁をされていた方なので、女性弁護士としての働き方等についてもお話ができました。Ｉ talked alot with Gehui Gao (Partner Attorney at Law). As she was a “Gaiben” , she and I talked about the life-style.
昨日は、京都セミナー最終日でした。Yesterday was the last day of the Kyoto Seminar.
修了証を松宮学部長からいただきました。We got Certificate of Completion from Dean Takaaki Matsumiya .
この一週間、様々な国の方と議論し、友情を深めることができました。
This week ,I could discuss and make friends with many foreign students.
今日は、日本と海外両方の渉外事務所弁護士の方からお話を伺いました。Today’s class was “Working as Inernational Attorney in Japan”.We heard stories from Bengoshi and Gaiben.
特に、法曹資格取得のオーストラリアと日本の制度の違い、ワークライフバランスについて興味深く拝聴しました。
Especially, it was very interesting to hear the difference of the way to be a lawer or judge or prosecutor between Japan and Autralia.
大阪地方裁判所の傍聴にも参加しました。思いもかけず、裁判官の方自らが裁判についてお話くださいました。とても貴重な体験でした。I was in the courtroom to listen to the proceedings at Osaka Disrict Court. Unexpectedly, the judge explained about the trial. It was a valuable experience for us.
日本の法曹の誠実さが伝わったのではないかと思います。I think foreign students were affected by sincerity of Japanese judge.
また、授業後には、関西テレビの取材も受けるなど、ハプニングの多い1日でした。After the class, the member of our group were interviewed from Kansai TV .
今日は、民事法、ADR、消費者法の授業を受けました。Today, I learned Civil Justice & Law, ADR , Consumers & Law.
オーストラリアの刑事法には、日本と違った点がみられましたが、民事法に関しては、似ている面が多いように感じました。Though Criminal Justice & Law in Australia is so different from the Japanese one , as for Civil Justice & Law , I think it is similar to Japan.
消費者法の授業では、日本の食品事故について紹介されたのが印象的でした。また、消費者法の歴史はどの国も同じような過程をたどるものだと感じました。In the Class of Consumers & Law, it was so impressive that the accidents of Japanese food were introduced. I understood that the history of Consumers & Law follows the similar way of other countries.
帰りには、京都タワーが見えました。On the way home, I could see the Kyoto tower.
今日は、政治と憲法、刑事法を学びました。I learned Politics & Constitutional Law , and Criminal Justice & Law today.
外国の学生に日本の制度や憲法に対する考え方を説明することは、難しいと改めて感じました。I realized how difficult to explain to the foreign students about Japanese institutions and the attitude toward the Constitution.
憲法の授業では、憲法九条を中心に日本の将来について真剣に考えたり、他の国の方の見方を学んだりました。In Constitutional Law Class, we think about the future of Japan seriously,especially Article 9, and learn several viewpoints of the other countires .
刑事法では、オーストラリアの刑事手続との比較等をして、日本の刑事制度のあり方について考えました。In Criminal Justice & Law class, we think about the way Japanese Criminal system ought to be compared with that of the Australia.
クラスには、オーストラリアでもうすぐ弁護士になる学生もいます。近い将来,東京での再会が楽しみです。In our class, there are students who will be lawyers. I am looking forward to seeing them again!!

今日は京都セミナーに参加しました。Today was the first day of the Kyoto Seminar.
オーストラリア、シンガポール、スリランカ、韓国、中国、マレーシアから来たみさなさんと英語で日本法の歴史・構造・理念、ジェンダーと法律について学びました。I learned Japanese Legal History , Legal Structure and Theory, Gender and Law with people from Australia, Singapore, Sri Lanka, Korea, China,and Malaysia.
日本の法律を深く学びたいという様々な国のみなさんと一緒に授業を受けるのは、非常に刺激的でした。It was very exciting to learn with foreign students who want to learn Japanese law deeply.
日本の法制度や社会について他の国々のそれと比較できたことも有意義でした。It was also significant to compare Japanese Law Structure and Society with them of other countries!
